Who is telling you that? Changing your operating system has nothing to do with it. As long as you don't change whatever legacy voice plan you have, you should also be able to keep the unlimited data plan, provided your old phone was a smartphone and you had the unlimited data plan for smartphones. If your old phone was not a smart phone, then no the unlimited data plan for non-smartphones can not be kept on your new smartphone.
