There is a 14 day buyers remorse period. If they suggest an upgrade, get the phone and moniter your usage over 14 days. You should use a little under half of what your monthly data alottment is by that time using what you normally do. If it appears you are still going over, or the phone isn't the problem, you can return it w/i 14 day sand just pay the restocking fee. You won't be under contract any more and you will be free to explore other options to find a resolution.
